Washington State Ballot Initiative: Redefining School Choice


Parents, community members, and taxpayers across the nation have been loud and clear regarding what they expect from public schools.
1) They want accountability; but do not want schools turned into centers of testing and test preparation instead of centers of learning.
2) They want safe, student-centered, and instructionally-rich environments that include art, music, and P.E.
3) They want reasonable class sizes and believe that class-size matters.
4) They want stronger local control and less federal and state control.
5) They want less standardization, less intrusive rules, less tests, and less data collection.
6) They want to retain parent rights, and not have them weakened by new FERPA regulations.

Education policy-wonks, education reformers, foundations, and legislators in both establishments persist in ignoring these concerns and persist in forcing their definition of education reform.

Washington State is one of  nine states that do not allow charter schools. "Washington voters have rejected charter schools three times before -- in 1996, 2000 and a third time in 2004." This November, voters will revisit this situation again via a ballot initiative 1240, based on a petition drive. The three week petition drive was funded this way:
According to Public Disclosure Commission filings posted Tuesday, Yes On 1240 has raised a total of $2.3 million and spent about $2.1 million to gather about 350,000 signatures. Most of the money has come from Washington technology leaders, including Microsoft co-founder Bill Gates, who donated $1 million.
Other reported funds and funders of the petition drive included $100,000 from Microsoft co-founder Paul Allen, and $200,000 from Katherine Binder, chairwoman of EMFCO Holdings, $150,000 has been donated to the campaign from out-of-state, and $50,000 from Democrats for Education Reform, which is based in New York but has a presence in Washington state.

The successful petition drive was organized by Winner & Mandabach of Santa Monica, California, a company that specializes in "big-buck initiatives." 

The final and approved wording on the ballot measure read as follows:

Title:  
             Initiative Measure No. 1240 concerns creation of a public charter school system.

Concise description:
This measure would authorize up to forty publicly-funded charter schools open to all students, operated through approved, nonreligious, nonprofit organizations, with government oversight; and modify certain laws applicable to them as public schools.

Ballot measure summary limited to 75 words:
This measure would allow a newly-created state commission or approved local school boards to authorize qualifying nonreligious, nonprofit organizations to operate public charter schools, limited to forty schools over five years. Public charter schools would receive standard per-student public school funding and be open to all students without tuition. Public charter schools would be subject to teacher certification requirements, government oversight, and performance reporting requirements, but exempt from certain state laws and school district policies.

What voters are unlikely to read is the 39-page detailed implementation plan or the "conversion charters" plan tucked within it.  These new public charters would be free of regulations required of the public schools except for testing requirements. Conversion charters permit parents or teachers to vote to turn a standard public school into a charter school via a petition process. While controversial so-called parent trigger laws are restricted to low performing schools and rely on a petition process, this ballot initiative allows any school including high performing schools to "convert."

 I1240 proponents attempt to distinguish "conversion" from "parent trigger" this way:
"...there is no parent or teacher “trigger” in I-1240. Under I-1240, it’s possible for a traditional public school to convert to a charter school only if the school meets rigorous application requirements, and demonstrates community need and parent and community support. One additional requirement before that conversion could happen is that either a majority of the parents or a majority of the teachers would have to sign a petition supporting the conversion. However, this is an additional requirement to demonstrate support for the school — a petition alone would mean nothing."
Parents, community members, and taxpayers are not so easily fooled by changes in a word or two and creating new definitions. Pass it now, fix it later is a bad idea. The devil is in the details, or lack of, and Washington state voters would do well to reject this ballot initiative. What is clear for the rest of the nation is that charter expansion for all is the goal.

While public schools strain under regulations, public charters would not. How does this make any sense? Wouldn't the public be better served by wider discussion of what type of customized conversion schools would be developed even in those areas where students demonstrate high achievement? How do customized schools navigate in a standardized-driven top down environment? Without that conversation first, how much more experimentation on children should the taxpayers be willing to pay for?

Below is a section of the final text of the ballot measure that references a conversion.

Part II
Sec. 201: (8) "Conversion charter school" means a charter school created by converting an existing noncharter public school in its entirety to a charter
school under this chapter.
(9) "New charter school" means any charter school established under this chapter that is not a conversion charter school.
Sec. 205: (3) A conversion charter school must provide sufficient capacity to enroll all students who wish to remain enrolled in the school after its conversion to a charter school, and may not displace students enrolled before the chartering process.
Sec. 213: (3) In the case of an application to establish a conversion charter school, the applicant must also demonstrate support for the proposed conversion by a petition signed by a majority of teachers assigned to the school or a petition signed by a majority of parents of students in the school.
Sec. 222: (6) Conversion charter schools are eligible for local levy moneys approved by the voters before the conversion start-up date of the school as determined by the authorizer, and the school district must allocate levy moneys to a conversion charter school.
Sec. 223: (5) A conversion charter school as part of the consideration for providing educational services under the charter contract may continue to use its existing facility without paying rent to the school district that owns the facility. The district remains responsible for major repairs and safety upgrades that may be required for the continued use of the facility as a public school. The charter school is responsible for routine maintenance of the facility including, but not limited to, cleaning, painting, gardening, and landscaping. The charter contract of a conversion charter school using existing facilities that are owned by its school district must include reasonable and customary terms regarding the use of the existing facility that are binding upon the school district. Florida Charter School "Boom": Warning Signs

There is a charter boom going on with too many oddities:

1) 15 of 30 "F" schools in Florida are charters. "Then last year in Florida, charter schools received 15 out of 31 of all the failing FCAT grades that went to public schools. Charter elementary and middle schools were seven times more likely to get an F than traditional public schools."

2) VP Joe Biden's brother is associated with charter Mavericks HS, which has accounting and performance issues - plus a desire to open 100. Third whistle blower on alleged fraud emerges. Frank Biden has real estate experience.

3) Parents signed up for an arts-oriented charter, but were not told of its association with Scientology.

4) Duval School Board, in North Florida, followed the rules on charter applications and denied an application. The charter took it to an Charter School Appeal Board established by the State School Board. The appeal board sided with the school board and against the charter. The charter took it to the State Board (all members are appointed), which overturned the appeal board and the district. The district is taking this one to court. What are the rules? Who decides? Murky. More loss of local control?

5) Then there was the recent Parent Trigger mess. Florida residents were denied opportunity to speak at committee meetings and at hearings to give opposing views, while proponents from outside the State were given that access. This is hardly an example of democracy. The good news is that the bill failed. It deserved to fail...the "devil is in the details."

6) Florida took RT3 funding and school districts are under strain trying to meet the requirements.

7) In Florida, former Governor Jeb Bush and his Foundation exert too much power.  The Director of his foundation, Patricia Levesque, is adviser to Governor Scott. Her husband is also General Counsel to the Florida House. When voting on charter bills, he advised no conflict of interest nor ethics violation for legislators with personal ties or ties via family to vote on those bills IF the bill did not affect only that family business. 8) Last week the Florida DOE issued a report on public charter progress. While some point to the report as clear evidence that charters are "better" than traditional schools, the report itself does not identify variances. One critical factor is that of the total number of public charters in Florida, the performance of only 40% are included in the report. The remaining 60% are not required to be "graded" because the size of the student population is too small to be statistically relevant and under Florida law are excluded. So while we applaud student achievement, growth, and progress wherever it exists, taxpayers still have no information that affirms the disruption leads to any return on investment. There are too many unknowns to recommend Florida's charter boom as a scalable model to replicate.

What happens in Florida is worth watching. These initiatives are heralded in other states as models to follow; however, they do not hold up under scrutiny. Legislators should analyze carefully what is in the best interests of their states students, parents, community members, and taxpayers. Careful deliberation and legislative accountability is not a sign of being anti-charter nor anti-accountability; but rather a sign of doing the job they were elected to do.

Charter Schools 101: Buyer Beware

Although Florida parents have been testing the charter school waters over the years, I was unable to locate a comprehensive analysis that examined how many parents stayed, how long did they stay, and if they left, where did they take the children? Anecdotal evidence indicates that some parents have been satisfied with their charter school experiences; others not so much. The forces of power, access, and money fueling the spike in charter school expansion are certainly counting on more of the former and less of the latter.

To that end, it is not surprising to learn that the Walton Foundation is funding a new Florida lobbying organization with members, such as KIPP, a nationally recognized charter management company, and Patty Levesque from Jeb Bush's Foundation and also an education advisor to Governor Scott.

Other players in the scene include Charter USA's CEO Jonathon Hage, who was also on Governor Scott's education transition team. Charter USA will challenge Polk County's decision to reject the application to open charters in that county.

Recently, House Representative Erik Fresen was cleared by the Ethics Commission, which investigated a complaint asserting he failed to disclose a conflict of interest as it pertained to SB7195, a bill making it easier for charters to expand. Supporting the complaint is the fact that Fresen's sister and brother-in-law work for Academia, which operates 12 charters in Florida. The Ethics Commission found that since passage of SB7195 affects all charter schools and not just Academia, no conflict of interest applies. Then, there is Vice President Joe Biden's youngest brother, Frank Biden, who is president and director of development for Mavericks High School, charter management company. Biden plans to open 100 more charters for at risk and high school drop outs in the next year and a half.

The Mavericks High School charter has an interesting focus and since they already operate 8 schools, I decided to see what information was easily available that would help a parent make an informed decision. I discovered that Mavericks has been operating in Florida since 2007, but I was unable to uncover performance data, retention information, or graduation rates.

How will parents make informed decisions?

This question must be on the minds of many right now. According to one report, Florida parents are showing greater interest in charter schools. The same report provides a questions for parents to consider before making a decision to change from a public school to a charter. Here's that list of questions:

Here are some questions to ask when deciding whether a charter is right for your family and, if so, which one.

What is the basis of the charter school's curriculum, and how does it incorporate Florida's common-core requirements?

How is learning evaluated? Do students get report cards or grades? Do they use books or iPads?

How experienced are the teachers, the principal and other administrators?

Does the school offer extracurricular activities such as music, art or sports?

Who sits on the school board, and when does it meet?

Aside from state and federal funding, where does the school get its money: community fundraising, private foundations?

How successful is the school? How long has it been around? Is it financially sound, and how do students perform on state-mandated tests?

Because charter schools typically don't provide transportation, is the location convenient?


Although the list puts school success and track record near the bottom of the list, I think parents would be wise in this environment to move that question up and be prepared to make a personal visit to the charter and a call or two to the school district office to get some answers to that question. Each charter stands on its own, so it is hard to say if Florida-wide performance is even available. There is much to consider and charters are not for everyone.

In short, buyer beware. There is much to consider.

Charter Schools: Parent Caution Advisory

While charter school expansion continues in Florida, so do the challenges to local decision-making. KIPP is a nationally recognized charter operator; however, KIPP Jacksonville operates a middle school with an "F" performance. The charter's application to open two new charters was questioned by the Duval School Board, which asked KIPP to explain why they should approve an application for more schools when they are operating one with an "F". Duval will vote on the application on November 1; however, KIPP has said they will appeal if their application is rejected.

Parents, community members, and taxpayers rely on school boards, who have the mandated responsibility of approving applications to open charters, monitoring them, and closing those who are non-performing. The application itself does not include reporting on a charter's performance history. Education Commissioner Gerard Robinson does not believe the application should include such information; however he does believe that school boards must consider charter performance as part of their decision-making process. In a Florida Department of Education statement, Robinson's views were clarified:
The Commissioner contends that performance of charter schools should be taken into consideration prior to any new charter school development because providing a quality learning environment for all students is paramount.

The Florida Times-Union quotes Greg Richmond, president of the National Association of Charter School Authorizers, who said that "a poorly performing school shouldn’t be approved to open new schools."
“KIPP nationally is a great organization, but every school still has to earn its own way,” Richmond said.

“So if you’re an 'F’ school, you’ve got to bring that grade up before you can start talking about opening some more schools.”


The November 1 decision is one to follow as well as Charter USA's challenge to the recent Polk County School Board's rejection of their application.

Charter Schools: The Tale of Many Cities

This week Florida Senator David Simmons, chair of the PreK-12 Budget subcommittee, commented at a recent meeting that charter failures in the state are worrisome. Simmons had this to say:
“The finanical impact is great,” he said. “Some of them are failing, and that’s a financial issue…Those that are failing are costing not only a human toll but a financial one.”

Some examples that may have crossed Simmons desk include:

The Miami-Herald reported that two Miami-Dade charter schools, the Academy of Arts and Minds and the Balere Language Academy, were shut down last week.

Many parents have been complaining that The Academy of Arts and Minds the school did not have enough books or teachers when school started in August. Parents have also complained about the school’s governing board decision-making, when the decided to hire the charter founder and landlord, Alonso-Poch, to also be "the school’s manager under a $90,000 no-bid contract." The chairwoman of the school’s board did not vote in this decision; however, Ruth “Chuny” Montaner is Alonso-Poch’s cousin.

Balere Language Academy troubles include a pending foreclosure lawsuit on its school building, $136,000 in outstanding debts, including $99,000 owed to a previous landlord, and is "under investigation after advertisements surfaced indicating that the school was being used as an adult-themed nightclub on the weekends. The school’s principal, Rocka Malik, has denied that the school was doubling as a club — though a phone number on the ads comes back to her husband’s business.

A West Melbourne charter school is in danger of closing due to poor performance. The charter's parent management company has sent $1 million to keep the school going and redirected to improvement. Nevertheless, parents have been pulling their children out of the school. A Florida Today article reviews the rather interesting real estate purchases and sales that has flowed into the investment. Two Imagine Charter schools, located in North Lauderdale, are also failing as identified in an investigative report by Scathing Purple Musings. This report revealed that 15 of 31 "F" schools in Florida are charters. Imagine Schools CEO Dennis Bakke was on Governor Scott's education transition team.

As charter applications are on the rise, Simmons interest is timely. Such events are not limited to Florida.

UPDATE: Bad News for Governor Scott: Charter schools are not making the grade in Florida

Governor Scott has an unexpected surprise. He chose the KIPP Impact Middle charter school as the location to sign Florida's education reform legislation. He likely chose the school because of the praise it received from Michelle Rhee and a visit by Arne Duncan. During Secretary Duncan's visit, the school was a beneficiary of $500,000 from the federal government as part of a $14 million dollar grant given to the KIPP Corporation. All this was before the FCAT scores were published. The school scored an "F." Oops for Governor Scott.

The principal of the school said that deeper assessments need to be put into place, a sign that they hadn't collected enough test-driven data. As long as data is the only method for examining such low test scores, it is fairly easy to predict what next year's scores will be and impossible to know what capabilities the students have acquired. Was the music program successful? The principal had this to say:
“We’re disappointed,” Principal Robert Hawke said. “We fell pretty far short of where we wanted to be.”

Pretty far short? There really isn't any farther short to go.

The narrative continues to highlight the overnight successes of charter schools eclipsing a more realistic view of accomplishments. In an accountability environment, cherry-picking is not honest. The fact is that charters are not perfect and not the silver bullet they are touted to be. Were it not for the continued reporting of overnight turnaround successes attributed to the KIPP model and the attention lavished on this particular school when it opened, Governor Scott would likely have chosen another place to sign the bill. Luckily, it shined a spotlight on a story that goes underreported.

UPDATE - More charter school bad news emerged this week. After three years of being an "A" school, a Lee County charter school gets an "F" this year. The school is investigating for possible cheating. However, as pointed out in Scathing Purple Musings:
Cheating and demographics aside, Floridians are getting more evidence that charters are not the sort of panacea that school reformers what them to believe.

Jeb Bush Under the Microscope

In a June 23 Wall Street Journal op-ed, former Governor Jeb Bush and Joel Klein made a case in favor of national standards. "The Case for Common Core Standards" reflects their views on the rationale and importance of national standards:
The success of today's students will determine our nation's destiny. America's economic strength and standing in the world economy are directly linked to our ability to equip students with the knowledge and skills to succeed in the 21st-century economy.

However, Greg Forster, posting on Jay P. Greene's blog, that instead of making a case for national standards, Bush and Klein were actually making a case against them. In "Confusion of National Standards," Forster asks:
Bush and Klein argue that standards are being set nationally (in “common”) but pedagogy isn’t. Once again, let’s leave aside the reality that you can’t have national (common) standards while preserving freedom and diversity of pedagogy. Let’s pretend you can set national standards and then let a thousand flowers bloom on pedagogy. Why do it? Why is it valuable to set a single national (common) standard? The article’s title promises an answer to that question, but the article doesn’t deliver.

"Joel Klein is the new education czar (CEO of the educational division) for News Corp, the parent company of WSJ. Those who have the media in their hands and foundation/government money behind them, plus other like-minded contacts in high places, exert an incredible amount of influence over education policy and funding. The WSJ op-ed by Bush & Klein made no case whatsoever to the rational person, as circular logic built on false premises is a conduit to deception."
